European Union (Planning and Development) (Renewable Energy) Regulations 2026 Circular CEPP 3/2026

This circular informs planning authorities, the Commission and other stakeholders that the European Union (Planning and Development) (Renewable Energy) Regulations 2026 (S.I. No. 323 of 2026) have been made. The Minister signed the Regulations on 9 July 2026, and they came into operation on that date.

The Regulations amend sections 37B and 37D of the Planning and Development Act 2000.

They allow the pre-application consultation process and the environmental impact assessment scoping process to take place at the same time for renewable energy development and repowering development, with conditions.

The purpose of the Regulations is to reduce delays, improve the operation of the RED III planning framework, and support the timely preparation of renewable energy and repowering applications.
