Minister O’Brien commences legal provisions to require landlords to register their tenancies with the RTB every year

With effect from 4 April 2022, landlords are required to register their tenancies with the RTB every year, within 1 month of their commencement or of the anniversary of when the tenancy began.

On 31 March 2022, Minister Darragh O’Brien signed the following Statutory Instruments:

  • the Residential Tenancies (Amendment) Act 2019 (Commencement) Order 2022
  • the Local Government Rates and Other Matters Act 2019 (Commencement) Order 2022
  • the Residential Tenancies (Amendment) Act 2021 (Commencement) Order 2022
  • the Residential Tenancies Act 2004 (Prescribed Form) Regulations 2022

The 3 commencement orders provide for the necessary legislative underpinning to require the annual registration of tenancies with the Residential Tenancies Board (RTB) by landlords from 4 April 2022.

The Prescribed Form regulations provide for new prescribed forms to reflect the introduction of annual registration and include:

1. the application form to be furnished to the RTB by a landlord/agent to register a tenancy of a dwelling (or a licence in student specific accommodation);

2. the letters and statement to be issued by the RTB when acknowledging receipt of an application to register a tenancy; and

3. the form containing the information to be furnished by a landlord to the RTB to update, if required, the register during the year

Minister O’Brien stated:

“The introduction of annual registration is important in assisting the RTB in monitoring and regulating the sector. In comparison to the current system of registration, annual registration of tenancies (and licences in student specific accommodation) by landlords with the RTB is a simpler and more effective registration model for the rental sector. Registration reminders and support will be provided to landlords by the RTB to help compliance with this new annual obligation. Up-to-date registration data will help Government to better understand the rental sector and inform decision making in rental policy development.”

Registration fees have been reduced to take into account the new annual requirement. To further assist landlords in this changeover to annual registration, there will be a transition period in respect of the registration deadline that applies to any new tenancy commencing between 4 April and 3 July 2022 or any tenancy with the anniversary of their commencement date falling during that period. The registration deadline for those tenancies is midnight 3 August 2022. From 4 July 2022, any application to the RTB for annual registration of a tenancy must be made within 1 month of its commencement (or of the anniversary of the commencement of an existing tenancy). Otherwise, late fees apply.
