The Applicant [ ] received injuries when a near traffic collision occurred on [ ] [ ] in [ ] on the [ ]. An individual got out of his car and assaulted [ ] causing injuries to his mouth. The Applicant sustained dental injuries. The incident was reported to the Gardaí on the same day. There is no evidence to suggest that any action on the part of the Applicant caused the near collision which resulted in the subsequent assault. Therefore the Applicant's past convictions do not engage Article 14 of the Scheme.

The Applicant received no compensation from the offender in relation to this incident. Having considered the Applicant's claim and vouched expenses, I make the following award:

Dental Expenses - €8,734.00
