This application arises from an incident on [ ] at the Applicant's home in [ ].

The Applicant is aware that paragraph 21 of the Scheme requires that applications be made as soon as possible but, except in circumstances determined by the Tribunal to justify exceptional treatment, not later than three months after the event giving rise to the injuries.

This application was significantly late, the Tribunal having been first notified of the incident giving rise to the injury and the intended application, on [ ] the date of the application.

The Tribunal is asked therefore to determine the circumstances of this late application as justifying its exceptional treatment. The circumstances outlined by the Applicant are that her application was late because criminal proceedings were pending.

The Tribunal does not accept in the circumstances that pending criminal proceedings is a circumstance justifying exceptional treatment of a late application.

For the reasons outlined above, the Tribunal is not satisfied in all the circumstances of this late application that exceptional treatment is justified, and the Application is therefore dismissed.
