Facts/brief background

1. [ ] (“the applicant”) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).

2. On the [ ], the applicant was walking home after being out [ ]. They were approached by [ ]. The female attempted to rob his Girlfriend [ ]. The applicant attempted to assist his Girlfriend. While doing so, he was stabbed with a blade by one of the males in the arm and a number of times in the rib cage.

Garda report

3. The matter was reported to [ ] Garda Station. The suspect was identified and charged, but fled the jurisdiction. A European Arrest warrant has been issued for his arrest.

Injuries

4. The applicant was treated in [ ] Hospital for [ ] stab wounds to his shoulder and ribs. Fortunately, no significant damage was caused to any internal organs.

Losses claimed

5. The applicant was unable to return to work for a two week period (80 hours) and returned to work on the [ ]. The applicant sustained a total loss of €1,115.20. This loss has been vouched.

6. He also sustained hospital charge expenses in the sum of €320, GP charges of €60 and prescription charges of €39.53 and travel expenses in the sum of €22.40.

7. The total vouched out of pocket expenses amount to €1,557.13.

Decision

8. The Tribunal has no doubt that the applicant was the victim of a vicious and senseless assault, while protecting his Girlfriend from being robbed. Unfortunately, it is not within the remit of the Tribunal to award compensation for pain and suffering. The Tribunal can only make awards in respect of vouched out-of-pocket expenses. Accordingly, the Tribunal will make an award to the applicant in respect of his vouched out of pocket expenses in the sum of €1,557.13.
