Circular HMS 9/03, 15 August, 2003.
Planning and Development Acts 2000 - 2002
Part V - Housing Supply
A Chara,
I am directed by the Minister for the Environment, Heritage and Local Government to refer to previous guidelines and correspondence from this department in relation to the implementation by local authorities of Part V of the Planning and Development Acts 2000 – 2002.
Draft guidelines were prepared by the department on the implications of the changes to Part V contained in the Planning and Development (Amendment) Act 2002 and circulated to local authorities, relevant stakeholders and representative groups for observations. Following consideration of the comments received, the guidelines have been finalised and a copy is enclosed for your attention. They are intended to assist planning and housing authorities, approved housing bodies, developers, architects, planners and others in dealing with agreements under Part V and a number of other related matters.
The Guidelines are not a legal interpretation of the Acts or of any Regulations made under the Acts but rather practical advice addressing issues which may arise. A copy of this circular letter and guidelines is being forwarded under separate cover to each Director of Service – Housing and Planning and to all City, Town and Borough Councils. They are being made available on the department’s website – www.environ.ie and are also available on request by email.
To further assist local authorities and relevant stakeholders in regard to the implementation of Part V, it is intended to organise a series of regional seminars later in the year. Details of these seminars will be given to local authorities at the appropriate time. Any enquiries regarding this circular letter and guidelines should be directed to Mr. Garry Byrne at 01-888 2123 e-mail: garry_byrne@environ.ie
Mise le meas,
