The Minister of State with responsibility for Local Government and Planning, John Cummins TD, invites comments on the draft amendments to Part D of the Second Schedule to the Building Regulations (Materials and Workmanship) and the associated draft Technical Guidance Document D.
Why are we launching a Public Consultation?
The Building Regulations set out minimum standards for the design and construction of buildings and works to ensure the welfare, health and safety of people in and around such buildings. They are subject to ongoing review in the interests of safety and the well-being of persons in the built environment and to ensure that due regard is taken of changes in construction techniques, technological progress, innovation, legislative requirements and EU legislation.
A new Construction Products Regulation (Regulation 2024/3110) was published in the EU Official Journal on 18 December 2024. This EU Regulation, known as CPR 2024, repeals the previous CPR (Regulation (EU) No 305/2011), since 8 January 2026. CPR 2024 aims to achieve a well-functioning single market for construction products and contribute to the objectives of the green and digital transition, particularly the modern, resource-efficient and competitive economy.
In order to keep the Building Regulations in alignment with CPR 2024, it is proposed to amend Part D of the Second Schedule to Building Regulations (Materials and Workmanship) and its associated Technical Guidance Document to extend the definition of ‘proper materials’ to refer to CPR 2024. This will clarify that construction products which bear a CE mark in accordance with CPR 2024 or which comply with a harmonised technical specification under CPR 2024 will also be considered ‘proper materials’ in order to demonstrate compliance with the Building Regulations.
An opportunity has also been taken to improve the structure and readability of the draft Technical Guidance Document D.

What we will do with your response
Your feedback will be recorded, collated, analysed, and evaluated to determine appropriate changes to the Draft Building Regulations (Part D Amendment) Regulations 2026 and/or the Draft Technical Guidance Document D 2026 – Materials and Workmanship.
Comments received will be made available on the Department’s website, unless otherwise requested. All submissions received will be subject to the provisions of the Freedom of Information Act, Access to Information on the Environment Regulations and Data Protection legislation.
