How can service providers register?

Under the e-Evidence package, service providers offering services in the European Union must appoint a “designated establishment” or “legal representative” who will be responsible for receiving and responding to requests from law enforcement authorities for electronic evidence.
Under the package, the “designated establishment” or “legal representative” that is selected by the service provider is called an “addressee”.
The addressee will be legally responsible for receiving and responding to requests from law enforcement authorities for electronic evidence. The e-Evidence package also requires service providers to adequately resource their addressee in order to respond to and comply with e-Evidence orders.

Service providers must register their addressee via the EU Commission’s registration page (link below). You will be directed to a page titled ‘Notification Form for Service Providers’.

To register, you will need the following information:
1. An EU login account is required in order to access the registration portal. If you do not have an EU login account, please follow the European Commission’s step-by-step user guide on this topic.
2. Please ensure that you have the following information available:
a) Information about the Central Authority: The competent central authority in the Member State in which you wish to register your addressee. (For Ireland, please select ‘C/O of the Department of Justice, Home Affairs and Migration’)
b) Information about your company/organisation: Registered company name, contact details, registration number, corporate structure and types of services offered in the European Union.
Please Note: When inputting your company contact details (email and contact number), please ensure the details are correct.
c) Information about your Designated Establishment/Legal Representative: Contact details (including emergency contact and technical assistance contact), the official language(s) accepted for communication purposes, and which legal instrument(s) your addressee will be responsible for.
Please Note: Service providers can designate an addressee in Ireland for the receipt of orders under the following legal instruments: EU e-Evidence, and Mutual Legal Assistance.
Service providers will not be able to designate an addressee in Ireland for the purposes of the European Investigation Order (EIO) Directive 2014/41/EU, as Ireland is not currently opted in to this Directive.
Service providers will be required to designate an addressee in another EU Member State for the purposes of receiving orders under the EIO Directive.
d) Information about Available Data: information on the types of data applicable to each service offered - category of data, identifiers, period of availability. Service providers can also add any additional information on the services they offer and the associated data.
e) Technical information: the type of connection which will be used to connect to the national IT system (either the web-based interface or API)
3. At the end of the registration process, you will be required to digitally sign and upload a PDF version of the authorisation form.
4. Once you have submitted your registration form, you will receive an automated email confirming that your submission has been sent. Please ensure you provide the correct contact details i.e. email address and phone number.
5. Your registration is subject to validation by the Department of Justice, Home Affairs and Migration and you may be contacted by the department in order to validate the information you have provided.
