Decision outcome: The application is dismissed under Article 9 of the Scheme.
1. [ ] (‘the applicant’) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).
2. The Applicant lodged an application for personal injuries with the Criminal Injuries Compensation Tribunal received on the [ ] in respect of an incident which occurred on the [ ] at [ ] Night Club, [ ]. When outside a Night Club to which the Applicant was refused entry he patted the shoulder of the Security Guard who then hit him resulting in the applicant suffering a broken tooth. He reported the matter to An Garda Siochana and went to [ ] Garda Station and made a Statement.
3. The Applicant went to see his Dental Surgeon Dr [ ] who furnished him with a quote for dental treatment. The Applicant paid the sum of €25 in respect of a consultation on the [ ]. No other receipt is on the file.
4. He was written to by the Tribunal on the [ ] enclosing a copy of the Garda Report and asked him to know if he would let the Tribunal know if he becomes aware of the case being finalised.
5. No response has been received to that letter.
6. The Applicant was again written to on the [ ] attaching a copy of the Tribunal letter dated the [ ].
7. Nothing further has been heard from him. He was advised in the letter of the [ ] to furnish all documents for the Tribunal Member to consider by the [ ]. He was also advised that the application would be forwarded to a Tribunal Member with documents that are already on file thereafter for a determination.
8. Nothing further has been heard from the Applicant.
9. Article 9 of the scheme provides “no compensation will be payable unless the Tribunal is satisfied that the injury is such that compensation of not less than £50 (€63.50) should be awarded”.
10. The Applicant has submitted an invoice for €25. This is less than €63.50 and accordingly the application has not met the requirements of Article 9 of the scheme and the application is dismissed.
