Apply for a Derogation under the Local Authorities (Works) Act 1949

A local authority may need to carry out urgent remedial works, in the public interest, to alleviate damage from flooding, landslide, subsidence or other similar occurrences.

If these works need to take place during the Annual Close Season from October to June then the authority will need to apply to the Department of the Climate, Energy and the Environment for permission.

This permission is called a derogation under the Local Authorities (Works) Act 1949.

To apply for a derogation an application must be made in writing or by email to:
