A protected disclosure is a disclosure of information which, in the reasonable belief of a worker, tends to show one or more relevant wrongdoings that came to the attention of the worker in a work-related context and is disclosed in the manner prescribed in the Protected Disclosures Act 2014: https://www.irishstatutebook.ie/eli/2014/act/14/enacted/en/print.html as amended by the Protected Disclosures (Amendment) Act 2022: https://www.irishstatutebook.ie/eli/2022/act/27/enacted/en/print.html
Most people first contact their employer to report wrongdoing.
If you do not want to make a report to your employer, you can make a report to a prescribed person, generally a regulator in the relevant sector.
If you are not sure who to contact, you can make a report to the Protected Disclosures Commissioner – more information here.
If you are or were employed by a public body you may be able to make a report to Government Minister who has a responsibility for the public body. To make a protected disclosure to The Taoiseach, click the below document.
Note –Under the Act, all protected disclosures to the Minister or Minister of State must be transferred to the independent Protected Disclosures Commissioner.
The Protected Disclosures Act 2014 is intended to provide a robust statutory framework to protect workers who raise concerns regarding potential wrongdoing that has come to their attention in the workplace. The legislation provides a comprehensive suite of employment and other protections to employees making such disclosures that are penalised by their employer or suffer a detriment from a third party on account of raising concerns regarding possible wrongdoing in their workplace
The Department of the Taoiseach has procedures in place for protected disclosures that have been developed in line with the Protected Disclosures Act 2014 , and agreed upon by the management board.
These procedures detail:
The department has a strong commitment to ensuring its culture and working environment encourages, facilitates and supports employees.
Section 22 of the Protected Disclosure Act requires that annual reports be published in relation to disclosures received by the department.
There were no protected disclosures received between the years 2014 to 2022 inclusive.
